Terms of Service

These Terms are an agreement between you and Lifemaxx LLC ("Lifemaxx", "we", "us") covering your use of the BAP mobile application and this website (together, the "Service"). By using the Service you agree to them. If you do not agree, do not use the Service.

Please read section 4 carefully. BAP produces nutrition, cost and time figures that are estimates. It is not a medical, nutritional or dietary service, and nothing it shows you is medical advice.

1. Who may use the Service

You must be at least 13 years old. If you are under the age of majority where you live, you may use BAP only with the involvement of a parent or guardian. By using the Service you represent that you meet these requirements.

2. Your account

Some features require an account. You are responsible for keeping your credentials secure and for activity that happens under your account. Tell us promptly if you believe it has been compromised. You may delete your account at any time.

3. What BAP does

BAP takes a food you describe and produces an alternative recipe intended to be higher in protein, along with comparisons for calories, cost and preparation time. It also provides meal planning, a grocery list, a pantry inventory, and a nearby-shops map.

4. Estimates, nutrition, and no medical advice

This section matters more than the rest, so it is stated plainly.

  • Nutrition information is an estimate and is not medical advice. Check ingredient labels and consult a qualified professional for individual dietary needs.
  • Calorie, macronutrient, cost and time figures are calculated approximations derived from recipe data. They will not match what you actually make, buy, or pay.
  • Prices vary by shop, region and date. Cost figures are indicative only and are not offers or quotes.
  • BAP does not know your allergies, intolerances, medical conditions, medications or clinical requirements. You are responsible for confirming that any recipe is safe and appropriate for you. Always read the labels of the ingredients you actually use.
  • Recipes may be produced by automated systems and can contain errors. Apply ordinary judgement and safe food-handling practice, including proper cooking temperatures and storage.
  • Nothing in the Service creates a doctor–patient, dietitian–client or other professional relationship. Do not use BAP to diagnose or treat a health condition, and never disregard professional medical advice because of something you read in it.

5. Subscriptions and payment

BAP may offer paid features on a subscription basis.

  • Purchases made in the iOS app are processed by Apple and are governed by your agreement with Apple. We never receive your payment card details.
  • Subscriptions renew automatically at the then-current price until cancelled. Your account is charged for renewal within 24 hours before the current period ends.
  • Manage or cancel a subscription in your Apple ID settings, not in BAP. Cancelling stops the next renewal; it does not shorten the period you have already paid for.
  • Any free trial ends immediately if you buy a subscription during it. Unused trial time is forfeited.
  • Refunds are handled by Apple under its policies. We cannot issue refunds for App Store purchases.
  • We may change prices. Changes apply to future renewals and we will give notice as required by the platform and by law.

6. Acceptable use

Do not: break the law using the Service; reverse engineer, decompile or attempt to extract source code except where that restriction is unenforceable; scrape, bulk-download or resell our content; interfere with or overload our infrastructure; access another user's account; or submit content that is unlawful or infringing.

7. Your content

You keep ownership of what you put into BAP. You grant Lifemaxx a limited, non-exclusive, worldwide, royalty-free licence to host, store, reproduce and process that content solely to operate and improve the Service. That licence ends when you delete the content or your account, except for backup copies retained for a reasonable period.

8. Our content

The Service, including its recipes, text, design, and the BAP name and logo, is owned by Lifemaxx LLC and protected by intellectual property law. We grant you a personal, revocable, non-transferable, non-exclusive licence to use the app for your own non-commercial purposes. No other rights are granted.

9. Third-party services

The Service uses third parties for hosting, authentication, push delivery, payments, and map and places data, and may show information about businesses we do not operate. We are not responsible for third-party content, availability, pricing or accuracy, and listing a business is not an endorsement of it.

10. Availability and changes

We may modify, suspend or discontinue any part of the Service at any time. We will make reasonable efforts to give notice of material changes that adversely affect a paid feature. We do not warrant that the Service will be uninterrupted or error-free.

11. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. We do not warrant that recipes, nutrition values, costs or times are accurate, complete or suitable for you. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIFEMAXX LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR FOR PERSONAL INJURY OR ILLNESS ARISING FROM FOOD PREPARED OR CONSUMED IN RELIANCE ON THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) USD $50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

13. Indemnity

You agree to indemnify and hold harmless Lifemaxx LLC and its members, officers and agents from claims, damages and reasonable legal fees arising out of your misuse of the Service or your breach of these Terms.

14. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or to protect the Service or other users. Sections 4, 7, 8 and 11 through 16 survive termination.

15. Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You and Lifemaxx agree to the exclusive jurisdiction of the state and federal courts located in Travis County, Texas, and waive any objection to venue there. Nothing here prevents either party from seeking relief in small-claims court.

16. Apple

These Terms are between you and Lifemaxx LLC, not Apple. Apple has no obligation to provide support for BAP. Apple is not responsible for any claim relating to the app, including product liability, a failure to conform to a legal requirement, or a consumer-protection claim. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

17. General

These Terms, with the Privacy Policy, are the entire agreement between us about the Service. If a provision is held unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger or sale of assets. We may update these Terms, and material changes will be notified in the app or on this page before taking effect.
